FAQ

Legal systems and traditions in Mexico and Canada are quite different. The Mexican system is based on codified law and the Canadian system is based on common law/precedents. You need a lawyer licensed and experienced in both Mexican and Canadian law to identify issues and differences in order to avoid unnecessary mistakes and expenses.  It is also important to ensure items are properly enforceable and structured to operate as intended in both jurisdictions.

You should hire a Mexican Canadian lawyer when you have legal needs Mexico. Generally speaking, when you need legal advice, defence or representation; particularly, when you are buying or selling real estate, dealing with timeshare scams or fraud or when you are starting a business.

Two main differences are insurance and ongoing professional education requirements.

Insurance requirements are an important difference between Mexico and Canada; lawyers in Mexico are NOT required to have insurance to practice law. A Canadian Lawyer and foreign legal consultant must hold an insurance policy to cover errors and omissions.  By hiring MC Law you get the peace of mind of being backed by a lawyer who carries such an insurance policy.

In Canada a lawyer must complete a certain amount of Continuing Professional Development, ensuring that MC Law is current on recent legal topics and ethics items.
If you hire MC Law you have over 24 years of experience on your side with unique expertise on the differences in the law, the legal systems, as well as the cultural and language differences. Additionally
you will not need to engage two or more counsels and can avoid hiring translators saving both time and money
